Law firms are usually comprised of multiple attorneys, frequently with specialties in different areas. When a business is choosing a law firm there are many things to research first. A business will want to choose a law firm that will best represent their interests. For example, a logging company would not want to chose a law firm that usually fights for environmental issues because it would represent a conflict of interest. Also, because law firms have many different attorneys representing that firm, the business in search of a law firm, would want to research each attorney that would be representing them. Research will also help a business decide which law firm has the highest success rate in representing a business of similar type.

While some businesses simply keep individual lawyers on retainer, most utilize the experience and expertise of a law firm. However, businesses are complicated by nature and have many different interests to look after. For example, if a business has an individual lawyer on retainer, rather than a law firm, and that business gets sued by a client, they may find that their lawyer has no experience in lawsuits. However, in most law firms, you can find at least one lawyer with experience in most legal arenas that a business will encounter. Law firms are made to be sure that their clients are covered, no matter what their legal difficulties.

Hiring a law firm can also be advantageous to a business because with multiple lawyers representing them, they often have more bargaining power and also confidence in what they do, since their law firm will usually advise them as to questions of law. When a business has a law firm on retainer, they may have lawyers from that firm check over contracts and other important documents to be sure that their interests are looked after. Big business may also utilize their law firm to go over their finances and taxes to ensure that they are not breaking any laws.

It is important to note how extensive each law firms experience is in working with businesses and especially businesses of comparable size. A large business of 5000 people would not want to choose a law firm that has only worked with small business and vice verse. The interests of small companies vary greatly form those of a large company.

Although it may be more expensive to keep a law firm on retainer versus an individual lawyer, for most businesses the benefits outweigh the cost. With a law firm, the business can be sure that they have lawyers with experience in taking care of all of their legal interests. The business will have confidence that their lawyers will be able to represent their company in the manner they expect. While an extremely small business may prefer to keep an individual lawyer on retainer, it makes sense for big business to utilize the services of a law firm. Because big business has multiple interests, it only makes sense that they would have multiple lawyers to look out for those interests.

State laws can sometimes be hard to understand because they are frequently different from state to state and may even conflict with federal law. State laws can also change without residents being aware of it and yet, it is an individuals responsibility to stay up to date on changes in state law. This is only one of the reasons it is important to stay current on state and local news. When a law changes the public is notified in a variety of ways, including newspaper publication and frequently television coverage. While knowledge of state laws is important, so to is knowledge of federal laws because federal law supersedes state law. Therefore, if a state law and federal law differ you could be prosecuted on a state or federal level simply for believing that what you were doing was legal according to one law, without knowledge that it was against another law.

Each state has their own variety of state laws. While you may be able to post large political signs on your property in New Jersey, it may be against state law in New York. Differing state laws are good reason to do research before you travel to another state. For instance, although some New Jersey roadways still have car pooling lanes meant only for those with multiple passengers in a vehicle, the law no longer applies and an individual driving alone may now utilize those lanes. However, according to New York state law, the car pooling law may still apply. It is important to know individual state laws, especially in the tri-state area where a person may go through multiple states on their commute to work. although a New Jersey resident may be used to ignoring car pooling laws, they may find themselves with a ticket when forced to obey New York state law.

Although the above example may only result in a small fine when state law is ignored; there are more significant state laws that vary state to state. For example, if an individual does not pay child support or falls behind in payments in one particular state, he may simply have his wages garnished. Yet, if this same individual resides in another state, he may find himself behind bars for getting behind on his child support payment because of that states laws. A person from Louisiana may be used to having people in their vehicles with open containers of alcohol. Yet, that driver would be prosecuted under New Jersey state law which makes open containers of alcohol in a vehicle a punishable offense. There are many examples of ways in which state laws may differ and that’s why research is important.

State laws are important to help maintain order for that states residences. Although we take those laws for granted and sometimes become complacent, ignorance of state law can only hurt the individual. Ignorance of state laws can end up causing legal difficulties for both state residents and for the traveler. Knowledge of state law and the consequences of breaking those laws, can protect individual rights and even individual property.

Defense Attorney

When it becomes necessary to acquire the services of an attorney, there are so steps that should be taken in order to ensure that you perform your attorney search correctly and effectively. In order to find attorneys that provide the service you require, perform an Internet search. For example, if you are trying to find attorneys that work in defending white collar crimes, you would use those key words to search the Internet. You would next want to check that they have significant experience in that area and where their offices are located. Last but not least, be sure you find attorneys that are within your price range.

Once you have performed your attorney search on the Internet and you have complied a list of names, it is advised that you ask around about them. Perhaps, it would be best to speak with previous clients and see that they are satisfied with the results. It is also a good idea to find out what their success rate it. For example, you would not want to hire an attorney that has had clients that all received a long sentence.
You want to be sure that your attorney search includes checking for their experience in the defense that you require. If, for example, you are accused of a white collar crime, you would not want to hire a divorce attorney. You would want to find attorneys that have significant experience in the defense that you require.

It is also important to check the location of each attorneys office. For example, you would not want to find attorneys that are hours away from you. Although you could speak with the attorney over the phone as frequently as you would like, it is not the same as face to face contact. It is essential, that you, as the client are comfortable with your attorney and it is easier to be comfortable if you are familiar with your attorney in a more personal sense. You must also consider that you may need to visit the office frequently for meetings and to sign paper work and there is a value added if you find attorneys that are closer to your home or work place.

When you find attorneys, you may also want to compare pricing. While one attorney may charge much more per hour, he may also have a higher success rate and more experience. It is important to take all of these factors into considering when comparing prices when you perform your attorney search.

There are many factors to consider during your attorney search. Sit and think for awhile in order to best decide what factors are important to you. For example, while price may not be a factor for you, location may be of greatest importance in your attorney search. When you find attorneys and compile your list, be sure to consider more than one attorney and to choose carefully. Be sure that you are comfortable with your attorneys plan for defense and that you agree with decisions he or she has made regarding your case.

Becoming an attorney requires many hours studying law and many other general education requirements. However, one vital requirement for attorneys to be successful is that they follow a strict code of ethics. Although general ethics principles can be taught in a classroom, ethics are really something that grows with an individual and their personal experience. It is important that attorneys understand that basic ethical principles apply to everyone, not just in some cases, but in all cases. There are some attorneys that get into the field of law for the money and prestige. There are also some attorneys that study law so that they can help others. However, either individual must follow the strict code of ethics that come with being an attorney.

If a person becomes an attorney in order to make a lot of money, become partner and maybe eventually have their own practice, they are probably joining the field of law for the money and prestige. In order to become a successful attorney in this sense, many people will do whatever they have to do to get to the top. This will often include many long hours working on multiple, high profile cases and sacrificing time with family and friends. Unfortunately, this sometimes gives these attorneys a sense of entitlement and they make take liberties with peoples rights in order to get what they want most, success. There are many attorneys that are highly successful without ever compromising their ethics, but there are also many that sacrifice ethics for the their own personal greater good. Yet, the reality is that attorneys must not even sacrifice ethics for their clients greater good. The reason for violating ethics is never important, it is only that they were violated that is of importance.

For example, an attorney can not pay a witness to say what he wants the jury to hear in order to clear their client. Imagine a lawyer pulling a person of the street and paying the $5000 to say that they were with his client on the night the crime was committed. This is quite obviously unethical. However, there are also shades of grey in ethics that are not so obvious. Look at the attorney that gets into law to help people. Would this attorney be able to steal money from a bank in order to fund his defense for an innocent client? Of course not. However, what if that attorney overcharged another wealthy client in order to fund the defense of a poor, innocent client. In either case, the attorney has violated ethics in the same way, regardless of the circumstances.

Becoming an attorney is considered a prestigious career. However, being an attorney is also a great responsibility. Attorneys greatest responsibility is to the law and they must not violate any ethical principles to defend or prosecute the law. Circumstances can not determine whether one follows ethical principles. Just as law is law, ethics are firm and fixed.

There are local, state and federal laws. Local laws apply to a persons township and county. State laws cover the entire state while federal laws cover the entire country. Every American citizen is required to know the laws that apply to them. However, this can get rather complicated when traveling from state to state as many laws change when doing so . the process of learning laws becomes easier when one realizes that federal law supersedes state law and state law supersedes local laws. In other words, one should learn Federal law first and local laws later because federal law is always going to apply where as state and local laws will only apply when you are in that area. It is important for every citizen to know the laws that pertain to them because ignorance of the law is not a valid defense.

Local and state laws cover things such as traffic laws. For example, in the state of New Jersey a driver is allowed to make a right turn at a red light unless otherwise posted. However, a driver is not allowed to make a right turn at a red light if a city exceeds a certain population count. The ability to generally make a right turn on red, is a state law. The inability to make a right turn on red in say Atlantic City, would be a local law. Although there is probably no federal law that says a driver can turn right on red in this country, there is also not one that says we cant. Therefore, the local laws do not conflict with federal laws.

However, a good example of conflicting federal laws and state laws is the legalization, by some states, of medical marijuana. Although New Jersey recently adopted a law that makes medical marijuana legal under certain circumstances, the individual using medical marijuana, could still be prosecuted under federal law. Therefore, every citizen must learn federal law to protect their rights. An individual using medical marijuana in New Jersey, could easily be prosecuted in federal court even though New Jersey says that it is legal.

Although these laws can become confusing, it is important to be familiar with them because ignorance of the law is not a defense. In other words, an individual can still be prosecuted even if they were not aware that what they did is illegal. This is because as citizens, it is our responsibility to know what we are allowed to do and not allowed to do according to the law. It is important to become familiar with the laws where you live, but also the laws of places you intend to travel. Just as a United States citizen in another country that breaks that country’s law will be prosecuted, so to, will a New jersey resident that breaks a New York law when traveling. Learning the laws that pertain to you, is the best way to protect your rights as a citizen and as a traveler.
